Frequently Asked Questions

Estate Planning Basics

What is Estate Planning?

A proper Estate Plan involves strategies to minimize potential estate taxes and settlement costs as well as to coordinate what would happen with your home, your investments, your business, your life insurance, your employee benefits (such as a 401K plan), and other property in the event of death or disability.

What is a Living Trust?

A Living Trust can be used to hold legal title to and provide a mechanism to manage your property. You (and your spouse) are the Trustee(s) and Beneficiaries of your trust during your lifetime. You also designate successor Trustees to carry out your instructions in case of death or incapacity.

Do You Need A Will?

A Will, also referred to as a Last Will and Testament, is primarily designed to transfer your assets according to your wishes. A Will also typically names someone to be your Executor, who is the person you designate to carry out your instructions.

POA's & Real Estate

A Durable Power of Attorney for Property allows you to carry on your financial affairs in the event that you become disabled. Unless you have a properly drafted power of attorney, it may be necessary to apply to a court to have a guardian or conservator appointed to make decisions for you during a period of incapacitation.

Should You Appoint A Guardian?

If you have children under the age of eighteen, you should designate a person or persons to be appointed guardian(s) over their person and property. If a surviving parent lives with the minor children (and has custody over them) he or she automatically continues to remain their sole guardian.

Why is an Estate Plan Important?

Many individuals don’t create an Estate Plan because they don’t think that they have “a lot of assets” or believe that their assets will be automatically shared among their children upon their passing. If you don’t make proper legal arrangements for the management of your assets after your passing, state laws will take over upon your death or incapacitation.

What Our Clients Are Saying

What a great place to get your affairs in order. We visited Jason at their beautiful office in Kierland. We felt right at home with the entire Family Tree staff. They put to rest all of our concerns and we left really feeling like we are in great hands. Thanks guys!

I have dealt with Jason and his staff at Family Tree on 2 separate occasions. The first time I had them establish a trust for our family and they did a great job. I was pleasantly surprised on how easy the process was. They really did all the work and I didn't have to stress. I was so impressed with trust I recently just set up my life insurance through them as well. I am a bit of a bargain shopper so I did call around and was pleasantly surprised they offered me such competitive rates and terms. I highly recommend trusting Family Tree with all of your estate planning needs.

We worked with Sean Cagle and Tim Laduca.  They made the entire process of putting together our living trust and funding it very simple! We started the process with another company, but switch because Family Tree will make life time amendments for us.  We were informed the entire process and very pleased.

I'm writing this review based on my parents experience. My parents have been searching for a company to do their living trust for quite some time now, but with some difficult circumstances going on with our family through the past couple years it was rough finding it in the budget. One thing that caught my parents eye was the free consultation. Sean was the rep who met with them, and helped explain the whole probate process how they could assist with my parents wants and needs. He was also very helpful by offering a payment plan for them since they're on a fixed income at the moment. My mom had no problems rescheduling the delivery because they wanted me to sit in on the delivery of the trust. I was impressed on how professional Sean was and just how much he cared about my parents being happy with outcome of their trust. 10/10 would recommend this company!

5-Stars: We have worked with Sean and Jason at Family Tree and they are both great guys and very helpful. We received a flyer in the mail from the company and set up an appointment with them. Jason not only helped us with our trust but we are now earning better interest on our annuity and both our IRA's. Would definitely recommend them.
